Dangerous Products

Just about any product can be dangerous. If you've been injured by using a product you may be entitled to compensation.

1) Design Defect - A design defect can happen when a product's design makes the product defective. Examples of defective products can range from lawn darts to medical drugs to the recent controversy surrounding Toyota and their accelerating cars. The product is manufactured as designed and is manufactured to the design specifications.. The problem is that the design specifications create a dangerous product.

2) Manufacture Defect - This happens when the product is designed properly, but a error in the manufacturing process leads to a defective product. These are usually 1-off problems. An example of this could be a shoe that comes apart when you use it. Or it could be a drug that was not manufactured properly. If manufactured properly the drug works as described, however, when manufactured improperly, it can be devastating.

3)  Failure to Warn - This is when the manufacture fails to provide proper warnings to consumers, especially when its foreseeable that a user will use the product a certain way. An example might be snow blowers that fail to warn that when ice gets clogged in the shoot- you should not put your hand in there to clean it out. Was it foreseeable that someone would stick their hand in there to clean out the ice? Yes. Was there a warning? No. This would lead to a lawsuit against the manufacture of the snow blower.

In a defective product lawsuit, in some cases you can sue every company in the selling chain. From the manufacture to the wholesaler to the retailer, they all cold be on the hook if the product is defective.

What You Can Do About Dangerous Products

There are numerous dangerous products available to consumers. Most companies will adhere to the law and attach proper warning labels to their products. But in certain cases, even companies can be misled by manufacturers of their products. Among the most noteworthy are toys manufactured in China that contain lead paint.

In addition to dangerous products there are products that can be defective. Defective or dangerous products are those products that can cause illness or physical injury to the consumer. There are many products types that fall into dangerous and defective categories. Products such as cleaning products, household cleaners, over-the-counter drugs, prescription drugs, toys, automobiles, automobile tires, office and industrial products, health and beauty aids, feminine hygiene products and medical devices all could be dangerous or defective.

The majority of manufacturers and companies that make and distribute these types of products will include warning labels and specific instructions on how the product is to be used correctly. This protects the companies from claims when the product is not used for the purposes it was designed, or with the necessary precautions. However, companies cannot be fully protected all of the time.

There could be a manufacturing defect in the production of a product.  There could also be product design defects that cause a product to become dangerous. Most of the time, once a manufacturing defect or product design flaw is discovered, they will issue a product recall. However, if the company fails to issue a recall and continues to distribute the products to consumers, they can be liable for injuries and illness caused by the products.

It is the responsibility of a company to properly warn consumers by labeling  products. The failure to do so leaves the company open to product liability claims. In certain instances, there are products that do not perform and violate the written or implied warranty. These types of products can also lead to product liability claims.

Unfortunately, it may take several years to discover that there is a defective or dangerous product on the market. During that time,  many consumers may have used the product. There may have been serious injury, illness or even death as a result of using the product.

When a consumer finds out that a product is defective or dangerous, they should immediately discontinue use of the product. The next step they should take is to contact a lawyer that specializes in product liability claims to determine if there is any legal recourse available.
